1. Acceptance of Terms

By accessing or using OutboundHost services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Service Description

OutboundHost provides email infrastructure services, including but not limited to domain management, DNS configuration, email sending, and deliverability monitoring.

3. Use of Service

You agree to:

  • Provide accurate and complete information when using the Service
  • Maintain the security of your account credentials
  • Comply with all applicable laws and regulations
  • Not use the Service to send spam (bulk or unsolicited email that does not comply with Section 4 and applicable law), malicious content, or for illegal activities

4. Acceptable Use for Sending

You may use the Service to send lawful business email, including cold B2B outreach. You agree to:

  • Have a lawful basis to email every recipient under the laws that apply to you (for example CAN-SPAM, GDPR/ePrivacy, and CASL), including consent where the law requires it
  • Not use purchased, rented, scraped, or harvested lists
  • Include a working unsubscribe or opt-out, and honor opt-outs within 2 days
  • Identify yourself truthfully: no impersonation, and no deceptive From names, domains, or subject lines
  • Keep spam complaints low. OutboundHost may throttle, pause, or suspend sending (for example when complaints exceed 0.3%) or suspend the account for abuse

5. Service Modifications

OutboundHost reserves the right to modify, suspend, or discontinue the Service at any time without prior notice. We are not liable for any modification, suspension, or discontinuation of the Service.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • OUTBOUNDHOST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUTBOUNDHOST'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PAST 12 MONTHS
  • WE ARE NOT RESPONSIBLE FOR DELIVERABILITY, EMAIL REPUTATION, OR THIRD-PARTY SERVICES

7. Indemnification

You agree to indemnify and hold harmless OutboundHost from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We may collect, use, and process data as described in the Privacy Policy.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

13. Entire Agreement

These Terms constitute the entire agreement between you and OutboundHost regarding the Service and supersede all prior agreements.
